Craig Thor Kimmel

Craig is one of the most experienced and respected consumer attorneys in the United States. Along with his partner, Robert M. Silverman, he has been called a pioneer in consumer protection and cost-free legal representation. Since 1989, he has devoted his practice solely to consumer claims, primarily Fair Debt Collection Practice Act (FDCPA) and Automobile Warranty “Lemon Law” claims. In 1997, he served as legal consultant to the Pennsylvania House of Representatives, and continues to consult with the Consumer Affairs Committee. He is credited with creating the only two amendments to the Pennsylvania Lemon Law and authoring the first Computer Lemon Law bill in the United States, which also served as a model for Illinois, Connecticut, and California. Mr. Kimmel has made appearances on national television discussing his cases and consumer law issues and has given interviews to newspapers, magazines and radio programs. Within the profession, Mr. Kimmel has been a keynote speaker for legal education seminars and has shared his experiences with community groups nationwide.

Mr. Kimmel does not represent businesses or business interests. He instead has chosen to represent individuals and has done so many thousands of times. He has also served as class counsel in cases that have pushed for product improvements and changes in how business responds to customers. He has successfully argued for clients at the United States Court of Appeals for the Third Circuit on matters having a national impact, that continue to be cited as authority.

In 1986, Mr. Kimmel earned his Bachelor of Arts Degrees from Ursinus College and in 1989 a Juris Doctor Degree from Widener University School of Law. Robert M. Silverman

Robert is highly regarded throughout the legal community for his continuing efforts in helping consumers with their breach of warranty claims. Mr. Silverman has been featured in The Philadelphia Inquirer and in other newspaper stories across New Jersey and Pennsylvania as an expert in warranty litigation.

Mr. Silverman has worked hard for consumer rights, trying his cases in the Federal and State Courts in which he practices. He has also successfully briefed and argued cases before the United States Court of Appeals for the Third Circuit.

Mr. Silverman earned his Bachelor of Arts Degree from Pennsylvania State University and holds a Juris Doctor Degree from Temple University School of Law. He is an attorney in good standing and has been admitted to practice in Pennsylvania, New Jersey, and New York. Mr. Silverman is an active member of the Philadelphia Trial Lawyers Association, the Pennsylvania Bar Association, the New Jersey Bar Association, and the New York Bar Association. He is a member in good standing with the American Bar Association.

Angela K. Troccoli

Angela K. Troccoli, Senior Associate, joined the Firm in 2006. Angela concentrates her practice on representing consumers for claims involving Lemon Law, Breach of Warranty, Consumer Fraud as well as representing individuals who are harassed by creditors and debt collectors with an emphasis on the Federal Fair Debt Collections Practices Act.

Prior to joining Kimmel & Silverman, P.C., Angela practiced in many different areas of civil litigation including real estate, domestic relations, trusts and estates, probate, breach of contract and personal injury.

From 1996 to 1999, Angela was a member of the New England Trial Advocacy Team, interned at the New Center for Legal Advocacy representing indigent clients as well as interned at the Office of the Attorney General in Providence, Rhode Island.

Jacob U. Ginsburg

Jake Ginsburg has represented consumers in hundreds of cases in state court, federal court and private arbitration. Jake handles both individual cases and class-actions in a variety of practice areas within the umbrella of consumer protection. Those practice areas include the Telephone Consumer Protection Act (“TCPA”), the Fair Debt Collection Practices Act (“FDCPA’”), the Fair Credit Reporting Act (“FCRA”), insurance bad faith, unfair trade practices and breach of warranty.

In class-action matters, Mr. Ginsburg has been approved as class counsel in various cases in state and federal court, and successfully negotiated six and seven figure class-settlements. Jake has tried and arbitrated cases to verdict throughout the country and successfully obtained reversals in the federal court of appeals.

Mr. Ginsburg has experience working at both large and small boutique law firms. Jake is a 2011 graduate of Temple Law School where he served as articles editor for the International and Comparative Law Journal.   • Burnett v. CallCore Media, Inc., Case No. 4:21-cv-03176, ECF No. 32 (S.D. Tex. June 25, 2024): $2 million class-action settlement received final approval in TCPA and Texas Business and Commerce Code case.
  • Kimble v. First Am. Home Warranty Corp., et al, ECF No. 50 (E.D. Mich. July 8, 2024): $700,000 class-action settlement in TCPA matter awarded final approval.
  • Giancristofaro et al. v. Ima Pizza, LLC d/b/a & Pizza, Case No. 23SL-CC04108 (Circuit Court of St. Louis County, Missouri) (March 27, 2024): Final approval granted for TCPA class-action settlement, which established $750,000 settlement fund.
  • Hall v. Smosh Dot Com, Inc., 72 F.4th 983 (Ninth Cir. June 30, 2023): Obtained reversal from unanimous Ninth Circuit appellate panel in TCPA case, on behalf of subscriber to cell phone who shared her phone with her son. The appellate panel expanded “Article III standing” to telephone subscribers who are not the “customary user” of a given phone registered on the Do-Not-Call Registry.
  • Beedle v. Prof’l Bureau of Collections of MD, Inc., 2:19-cv-5524 (E.D. Pa. June 28, 2022): Overcame FDCPA defendant’s motion for summary judgment where evidence showed the defendant’s collection calls continued after verbal and written cease-and-desist instructions from the consumer/plaintiff.
  • Muzyka v. Rash Curtis & Assocs., Case No. 2:18-cv-01097-WBS (E.D. Cal. July 3, 2019): Activities by debt collector otherwise outside the one-year statute of limitations may still be considered by the jury, as part of a “continuing violation”, if conduct continued through the statutory time-period.
  • Ruby v. Dish Network, LLC, 2:18-cv-00400-JHS (E.D. Pa. March 26, 2019): Overcame motion for summary judgment in TCPA case where dialing system called phone numbers from stored list. Court ruled the dialer could be an “automatic telephone dialing system” despite calling specific phone numbers.

Jordan Kingston

Jordan graduated from the University of Missouri—Kansas City (UMKC) in 2012, earning two Bachelor of the Arts degrees in American History and Political Science.

In 2015, he graduated from the University of Missouri—Columbia School of Law, passed the bar exam, and was admitted to practice in Missouri.

Yolanna obtained her Bachelors degree in Political Science from the University of Arkansas. Following her passion for the law, she obtained her Juris Doctorate from Inter American University of Puerto Rico School of Law, graduating Magna Cum Laude.
